VERNON, B.C. (CP) -- A provincial court judge has quashed a Vernon man's guilty plea to possession of child pornography because the law covering it has been ruled unconstitutional.
Judge W. Klinger ruled yesterday that Glenn Kelly's plea cannot stand after a ruling in January involving a Vancouver man.
Crown prosecutor Joyce DeWitt-Van Oosten said she will apply to have the case adjourned until after an appeal of the Vancouver ruling is heard in late April.
